Veterans Disability Lawsuit - How to File a Veterans Disability Lawsuit

For many veterans who suffer from disabilities caused by their military service, a disability lawsuit may be the solution. The Department of Veterans Affairs offers benefits to veterans, including medical treatment and special programs.

According to a lawsuit filed on Monday, Black veterans have disproportionately having a harder time in obtaining these benefits. The suit was filed on behalf of Conley Monk Jr. by Yale Law School's Veterans Legal Services Clinic.

PTSD

If someone experiences trauma they may be prone to develop symptoms of post-traumatic stress disorder (PTSD). The symptoms can include flashbacks, nightmares or anxiety that cause anxiety. The condition can also cause someone to avoid certain locations or situations that bring back memories of the traumatic event. This can lead people to feel isolated and depressed. The good news is that PTSD can be treated with the help of counseling, medication and support from family members.

A new lawsuit brought by Black veterans and a Yale law clinic has revealed that the Department of Hot springs veterans disability law firm Affairs has repeatedly denied disability compensation claims to Black veterans for years. NPR's Quil Lawrence says that a whistleblower revealed to the veterans that VA internal documents show Black veterans were denied benefits more frequently than their white counterparts.

The lawsuit was filed by Marine Vietnam veteran Conley monk and Yale's Veterans Legal Services Clinic. The lawsuit cites data that shows that from 2001 to 2020 the rejection rate for Black disability claims was 29.5 percent, compared with 24.2% for white veterans.

The lawsuit seeks damages for compensation for Monk and other Black veterans who were denied benefits. It also aims to force the VA to reassess the claims of thousands of other veterans who were incorrectly dismissed. The lawsuit was filed in federal court on Wednesday.

Traumatic Brain Injury

TBI can be mild, moderate or severe and symptoms may be immediately apparent or they may develop within a few hours or even weeks after the injury. Certain symptoms (headache dizziness, headache, fatigue) are physical, whereas others may be related to emotions, memory, concentration or behavior issues. TBI patients may also have difficulty moving or with balance and vision.

The brain damage caused by a TBI can be caused by a blow, bump or jolt to the head regardless of whether it was caused by a sharp force or penetrating wound (such as from a shot). The impact may cause the skull to break and cause bleeding and bruising of the brain inside the skull. The brain can then expand and push against the skull, causing a cut in blood flow. The injury can affect the whole brain or a specific lobe of the brain.

Some TBIs can be classified as closed while others as open. The classification is dependent on whether or not the skull has been fractured and whether the skull was opened or shut due to the impact. TBIs differ in severity, from a concussion up to a fatal coma. People with TBIs are more at risk chance of developing depression and PTSD and other mental health problems. Certain studies suggest that having multiple moderate to severe TBIs could increase the likelihood of developing dementia and movement problems in later years.

Post Traumatic Stress Disorder

Post traumatic stress disorder, or PTSD is a condition that occurs after people experience a trauma. The symptoms can manifest when the event is over or even years later. Memory problems, difficulties getting sleep and concentrating, or feelings of anger or irritability, and being easily shocked are some of the signs. Some people might experience depression or suicidal thoughts. PTSD can cause problems at work, home and even in relationships. It can also lead alcohol or drug addiction.

The symptoms can be treated with psychotherapy, such as eye movement desensitisation and reprocessing (EMDR) or cognitive processing therapy. Some people suffering from PTSD benefit from taking antidepressants, for example as selective serotonin receptor inhibitors or SNRIs. Medications can help to manage symptoms and help you get through everyday activities.

A few studies are looking at ways to avoid PTSD. This includes looking at whether genes and the brain can influence the way a person reacts to trauma. Researchers are looking into how a normal response to stress can develop into PTSD, and how to treat it early.

It is crucial to visit your doctor if you suffer from PTSD. It is essential to address symptoms that interfere with your daily routine, like difficulty in getting along with others, or being annoyed and frustrated. Some people with PTSD have the benefit of self-help which includes sharing their experiences in therapy or practicing methods of relaxation, such as deep breathing or exercise. They may also gain from being able share their fears with a trusted individual.

It involves speaking with an expert therapist about the problems which are causing you issues. It could also involve medications that can help boost your mood. There are numerous types of therapy. Cognitive behavioral therapy can help you change negative thoughts and behavior while interpersonal therapy is focused on relationships. There are group therapies which bring people who have similar issues together in a supportive environment.

The lawsuit asserts that the VA has discriminated against Black veterans for a long time, by rejecting disability compensation claim in a higher proportion than white veterans. The lawsuit was filed on behalf of Conley Monk, who is a Vietnam War veteran who tried to gain access to medical benefits including housing assistance, education and benefits for more than 50 years. The lawsuit is being handled by Yale Law School’s Veterans Legal Services Clinic. Monk was represented during his successful fight to overturn his less-than-honorable military discharge due to PTSD and other injuries.

The lawsuit claims that racial discrimination in the military justice system affected the discharge status of a number of Black service members, and VA officials should have known this when making disability compensation decisions. It cites a study that discovered that between 2001 and 2020, the average denial rate for Black veterans who applied for disability compensation was 29.5%, compared to 24.2% for white sugar hill veterans disability law firm.
