Veterans Disability Lawsuit - How to File a Veterans Disability Lawsuit

A veterans disability lawsuit could be the solution for a large number of veterans suffering from disabilities resulting from their military service. The Department of Veterans Affairs provides benefits to those who been in the military, such as medical care and specialty programs.

According to a lawsuit filed Monday, Black veterans have disproportionately more trouble getting these benefits. The Yale Law School Veterans Legal Services Clinic filed the suit on behalf of Conley M. Monk Jr.

PTSD

PTSD symptoms can manifest when people are traumatized. The symptoms include anxiety, nightmares or frightening flashbacks. The condition can make the sufferer to avoid situations or places that remind them of their traumatic experience. This can cause people to feel lonely and depressed. The good news is that PTSD can be treated with counseling, medication and support from loved ones.

A lawsuit that was filed by Black veterans and a Yale law clinic has revealed that the Department of Veterans Affairs has repeatedly denied disability compensation claims to Black vets for decades. Quil Lawrence of NPR reports that a VA whistleblower informed the veterans that VA documents revealed that Black veterans were denied benefits at a higher percentage than white veterans.

The lawsuit was filed by Marine Vietnam veteran Conley monk and Yale's Veterans Legal Services Clinic. It cites data showing that between 2001 and 2020, the rejection rate for Black disability claims was 29.5 percent, as compared to 24.2% for white veterans.

The lawsuit seeks to recover compensation for Monk and Black veterans who were unfairly denied benefits. The lawsuit also seeks to for the VA to reassess tens of thousands of other claims which were denied in error. The lawsuit was filed in federal court earlier this week.

Traumatic Brain Injury

TBI can be mild, moderate, or severe and symptoms may be instantly visible or they may appear within a few hours or even weeks after the injury. Some of the symptoms are physical (headache, fatigue and dizziness) while others can be associated with issues with memory and concentration, emotional or behavior. Some TBIs can be classified as closed and others as open. The classification is determined by the extent to which the skull was fractured and whether or not the skull was shattered or opened due to the impact. TBIs are a variety of severity, ranging from a concussion up to a death. People who have TBIs have a higher risk of developing depression and PTSD and other mental health problems. A few studies suggest that having several moderate to severe TBIs could increase the risk of dementia and other movement disorders later in life.

Post Traumatic Stress Disorder

Post traumatic stress disorder, or PTSD is the result of having to suffer a trauma. The symptoms can begin at the time that the event is over, or years later. They can include memory problems as well as difficulty in concentrating and sleeping, feelings of anger and irritability, and being easily frightened or jumpy. Certain people may have suicidal or depression-related thoughts. PTSD can cause issues at home, work and in relationships. It can also cause alcohol or drug addiction.

Psychotherapy can treat symptoms such as eye movement desensitisation (EMDR) and cognitive processing therapy. The suit is being filed by Yale Law School's Veterans Legal Services Clinic, which represented Monk in his successful effort to reverse his less than honorable military discharge due to PTSD and other injuries.

The lawsuit claims that racial discrimination in the justice system of the military affected the discharge status of a lot of Black service members, and VA officials should have been aware of this when they made disability compensation decisions. It cites a study that discovered that between 2001 and 2020 the average rate of denial for Black veterans who applied for disability compensation was 29.5 percent, compared to 24.2% for white veterans.
